What are the O-1A and O-1B Visas?

An O visa is a non-immigrant temporary worker visa granted by the US to an alien with exceptional ability in the sciences, arts, education, business, or athletics, or who has a demonstrated record of extraordinary achievement in the motion picture or television industry and has been recognized for those achievements. Individuals with extraordinary ability in the sciences, education, business, or athletics (excluding the arts, motion pictures, or television industry) are eligible for an O-1A Visa, whereas those with extraordinary ability in the arts or extraordinary achievement in the motion picture or television industry are eligible for an O-1B Visa.  

Can I work part time on O-1 visa?

You can live and work freely in the United States with this visa, as long as you keep the same job and maintain your relationship with your sponsor. If you want, you can enroll as a part-time student. They can even attend school, but only those with an O-1 visa are permitted to work.

How long is the O-3 visa valid?

Because the O-3 visa is a dependents visa, you must stay with the principal visa holder, which is either the O-1 or O-2 visa holder. Because O-1 and O-2 visas are initially issued for three years, your O-3 visa will be valid for three years as well.

How long can I stay in the U.S. on O-2 work visa?

You may stay in the United States on an O-2 visa for up to three years if it is decided that your presence is required to help the O-1 principal in completing the event or activity. What documents are needed to apply for a O-1 Visa?

The required documents for the O-1 Visa are: the Form I-129 which should be filed by your employer or agent 45 days before the employment to avoid delays; a valid passport; a 2×2 inch photography; proof demonstrating your extraordinary ability in the sciences, arts, business, education, or athletics, or extraordinary achievement in the motion picture industry; a written advisory opinion from a peer group (including labor organizations) or a person with expertise in the beneficiary’s area of ability; a copy of any written contract between you and the petitioner, the petitioner must provide an explanation of the nature of the events or activities, the beginning and ending dates for the events or activities and a copy of any itinerary for the events or activities.

Who is eligible for the O-1A Visa?

Extraordinary talent is determined in the same way for O-1A purposes as it is for EB-1A purposes (sciences, athletics, and business). Either the individual must show a one-time feat worthy of an Olympic Medal or a Nobel Prize, or they must some of the following criteria: Receiving lesser-known national and international accolades or awards for outstanding achievement in a particular subject; Membership in professional organizations that require members to have exceptional achievements as determined by experts in the subject; Publications about the individual in professional or significant trade publications, as well as appearances/publications about the individual in other prominent media, etc!  

What questions will spouses be asked in a O-3 Visa interview?

Most common questions during these interviews are: Can you show me a document that legally states your marriage to the O-1/O-2 Visa holder?; What do you plan on doing in the United States?; What is the duration for which you have been married to your current spouse?; What is the date of your marriage?; Do you have any family members residing in the United States?; What is the date of birth of your spouse?; Which organization does your spouse work for?, and more!
